Pilot tester agreement
Version 2026-11-04 (the date of this text). By creating an account for the Pourhound pilot, or continuing to use it, you agree to this, the Terms of use and the Privacy policy.
Pilot Tester Non-Disclosure Agreement
- Acceptance. This Pilot Tester Non-Disclosure Agreement (the "Agreement") is between Pourhound (the "Company") and you ("Tester"). By creating an account for, or continuing to use, the pre-release version of the Pourhound app and services (the "Trial"), Tester agrees to be bound by this Agreement, the Pourhound Terms of Use and the Privacy Policy. If Tester does not agree, Tester must not use the Trial.
- Confidential Information. "Confidential Information" means all non-public information disclosed by or on behalf of the Company in connection with the Trial, in any form, including software, features, functionality, designs, screens, user interfaces, content, documentation, business plans, pricing, partner, venue and supplier information, and information about other testers.
- Obligations. Tester shall (a) hold Confidential Information in strict confidence, using at least reasonable care; (b) not disclose it to any third party; (c) not copy, screenshot, record, publish or post it, in any medium; (d) use it solely to evaluate the Trial and provide feedback to the Company; and (e) not reverse engineer, decompile or disassemble the Trial software.
- Exclusions. Confidential Information does not include information that (a) is or becomes publicly available through no fault of Tester; (b) was known to Tester before disclosure, free of any obligation of confidence; (c) is lawfully received from a third party without restriction; or (d) is independently developed by Tester without use of Confidential Information. Tester may disclose Confidential Information to the extent required by law or court order, after giving the Company prompt notice where lawful.
- Protected rights. Nothing in this Agreement restricts Tester from (a) sharing Tester's honest review, opinion or assessment of the Company's products or services, to the extent protected by the Consumer Review Fairness Act (15 U.S.C. ยง 45b); (b) reporting a possible violation of law to, or cooperating with, any government agency; or (c) exercising any other right that cannot be waived by law.
- Feedback. Tester may, but need not, provide suggestions, comments or other feedback ("Feedback"). Tester grants the Company a perpetual, irrevocable, worldwide, royalty-free licence to use Feedback for any purpose, without obligation, payment or attribution.
- No licence; no warranty. All rights in the Trial and the Confidential Information remain with the Company. No licence is granted except the limited right to use the Trial during its term. THE TRIAL IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. Pre-release software may contain errors and may lose data.
- Term. This Agreement takes effect when Tester accepts it and ends on the earlier of (a) the Company's public announcement that the Trial has ended, or (b) twelve (12) months after acceptance. Sections 6, 7, 10 and 11 survive.
- Return or destruction. On the Company's request, or when Tester's access to the Trial ends, Tester shall delete any copies of Confidential Information in Tester's possession.
- Remedies. Tester acknowledges that unauthorised disclosure may cause the Company irreparable harm for which damages may be inadequate. The Company may seek injunctive relief in addition to any other remedy, and may suspend or end Tester's access to the Trial.
- General. This Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. It, together with the Terms of Use and Privacy Policy, is the entire agreement on its subject. If any provision is held unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. Tester may not assign this Agreement. The Company may update it by posting a new version in the app, which requires Tester's acceptance to continue using the Trial.
The fine print, translated
- What happens in the pilot stays in the pilot.
- Like a good bourbon, Pourhound isn't ready until it's ready. No sneaking samples out of the barrel.
- A screenshot of an unreleased feature is the angel's share, and we'd like to keep that one.
- Tell us everything. Tell everyone else nothing. When we launch, tell the whole world.
- Loving it? Say so. Hating it? Say so to us first, so we can fix it.
- If it leaks, the hound will find out. He has a nose for this sort of thing. ๐
- Thank you for testing. You're the reason the launch version won't be embarrassing.
Changes
A new version of this text carries a new date at the top, and the app asks every tester to agree to it again. When the pilot ends, the app says so once; the twelve-month cap in section 8 ends the agreement even if nobody flips the switch.
